Robbery Defined in Criminal Law
According to Penal Law Section (or Article) 160.00, robbery is defined as “forcible stealing”. It means that the victim is aware of the theft, as opposed to a Larceny where no one but the thief might be aware of the unlawful taking.
Forcible stealing is defined as occurring when, in the course of committing a larceny by taking property, a person uses or threatens use of “immediate physical force” upon another individual or group of individuals. Robbery can be accomplished by different methods. For example, a robber can overcome a victim’s resistance to the taking of property or by retaining it after the taking. Or a robber can force a property owner to give up property through coercion or duress.
There are different levels of robbery, which rise to Armed Robbery, or a forcible taking of property by displaying or using a firearm or other deadly weapon. This is Robbery in the First Degree, which is also charged when serious physical injury is caused to another during the unlawful taking of property.
