Burglary Defense

Defining Burglary in the Criminal Law

According to Penal Law Section (or Article) 140.20, burglary means knowingly entering or unlawfully remaining in a building with intent to commit a crime. As such, burglary is related to trespass, which means to knowingly enter or remain in a building or on real property unlawfully (regardless of any intent to commit a crime).

Penalties for Burglary

Penalties for burglary are harsh and can result in a mandatory terms of imprisonment, depending on the severity of the offense charged. For example:

■If the building is a dwelling, burglary rises in severity to Burglary in the Second Degree (P.L. §140.25).
■If the building is a dwelling and the perpetrator is armed or causes physical injury to any individual who is not a participant in the crime, the charge will be raised a notch to Burglary in the First Degree (P.L. §140.30).
■If a deadly weapon is used in the commission of a burglary, an additional count being charged: Criminal Possession of a Weapon.

■A defendant, who had been indicted on a charge of Criminal Possession of a Weapon in the Third Degree. His prior attorney had been unable to secure for him a disposition of less than a year in jail for the offense.
